1 Der Bundesrat bezeichnet eine Auskunftsstelle für Vergiftungen und sorgt für die finanzielle Abgeltung der an sie übertragenen Aufgaben.
2 Die Auskunftsstelle erteilt Auskünfte über die Verhütung und Behandlung von Vergiftungen und empfiehlt entsprechende Massnahmen; zu diesem Zweck sammelt und verarbeitet sie die erforderlichen Informationen einschliesslich jener über Vergiftungsfälle.
3 Sie hat uneingeschränkten Zugriff auf die Daten im Produkteregister (Art. 27) und ist berechtigt, direkt bei der Herstellerin weitere zur Wahrnehmung ihrer Aufgaben erforderliche Angaben über Stoffe und Zubereitungen zu verlangen.
4 Der Bundesrat trifft die notwendigen Massnahmen, damit die nach Absatz 3 zur Verfügung gestellten Daten vertraulich behandelt und Geschäfts- und Fabrikationsgeheimnisse gewahrt werden. Er bestimmt insbesondere, unter welchen Bedingungen und wieweit die Auskunftsstelle zu medizinischen Zwecken präventiver oder heilender Art Angaben über die Zusammensetzung und die Eigenschaften von Stoffen und Zubereitungen machen darf.
1 The Federal Council shall establish a poisons information centre and ensure that it is financially compensated for carrying out the tasks assigned to it.
2 The information centre shall provide information on the prevention and treatment of poisoning and shall recommend appropriate measures; to this end, it shall collect and process the necessary information, including details of cases of poisoning.
3 It shall have unrestricted access to the data in the product register (Art. 27) and shall be entitled to request the manufacturer directly to provide any additional information on substances and preparations that may be required for the fulfilment of its tasks.
4 The Federal Council shall take appropriate measures to ensure that the data made available in accordance with paragraph 3 is treated confidentially and that commercial and industrial secrets are protected. It shall specify in particular the conditions under which and the extent to which the information centre may, for medical purposes of a preventive or curative nature, disclose details of the composition and properties of substances and preparations.
