Art. 8a Pilotversuche

1 Das BAG kann nach Anhörung der betroffenen Kantone und Gemeinden wissenschaftliche Pilotversuche mit Betäubungsmitteln des Wirkungstyps Cannabis bewilligen:

a.
die örtlich, zeitlich und sachlich begrenzt sind;
b.
die es erlauben, Erkenntnisse darüber zu gewinnen, wie sich neue Regelungen auf den Umgang mit diesen Betäubungsmitteln zu nicht medizinischen Zwecken auswirken und wie sich der gesundheitliche Zustand der Teilnehmer entwickelt;
c.
die so durchgeführt werden, dass der Gesundheits- und Jugendschutz, der Schutz der öffentlichen Ordnung sowie die öffentliche Sicherheit gewährleistet sind; und
d.
in denen wenn möglich Cannabisprodukte verwendet werden, die Schweizer Herkunft sind und den Regeln der Schweizer Biolandwirtschaft entsprechen.

2 Der Bundesrat regelt die Voraussetzungen für die Durchführung der Pilotversuche. Dabei kann er von den Artikeln 8 Absätze 1 Buchstabe d und 5, 11, 13, 19 Absatz 1 Buchstabe f und 20 Absatz 1 Buchstaben d und e abweichen.

3 Betäubungsmittel des Wirkungstyps Cannabis, die im Rahmen der Pilotversuche abgegeben werden, sind von der Tabaksteuer nach Artikel 4 des Tabaksteuergesetzes vom 21. März 196948 befreit.

Art. 8a Pilot trials

1 After consulting the cantons and communes concerned, the Federal Office of Public Health may authorise scientific pilot trials involving narcotics containing an effective concentration of cannabinoids:

a.
that are limited in terms of location, time and subject matter;
b.
that allow findings to made on the impact of new regulations on the use of these narcotics for non-medical purposes and on the health of participants;
c.
that are conducted so as to ensure the protection of health and of minors, and the protection of public order and public safety; and
d.
in which, if possible, cannabis products are used that are of Swiss origin and that comply with the rules of Swiss organic farming.

2 The Federal Council shall regulate the requirements for conducting the pilot trials. In doing so, it may derogate from Articles 8 paragraphs 1 letter d and 5, 11, 13, 19 paragraph 1 letter f and 20 paragraph 1 letters d and e.

3 Narcotics containing an effective concentration of cannabinoids that are supplied in the course of the pilot trials are exempt from tobacco tax under Article 4 of the Tobacco Tax Act of 21 March 196948.
