Art. 38 Prüfungen durch eine Stelle

1 Das BAKOM lässt eine Fernmeldeanlage von einer Stelle nach Artikel 17 prüfen, wenn:

a.
die Prüfungen, die das BAKOM durchgeführt hat, belegen, dass diese Anlage die Anforderungen nach Artikel 7 oder 9 nicht erfüllt, und
b.
das Gesuch von der für die Bereitstellung dieser Anlage auf dem Markt verantwortlichen Person gestellt wird.

2 Bevor das BAKOM die Anlagen von einer Stelle nach Artikel 17 prüfen lässt, hört es die für die Bereitstellung auf dem Markt verantwortliche Person an, insbesondere betreffend die gewählte Stelle, den Umfang der Prüfung und deren geschätzten Kosten.

3 Die Kosten für die Prüfungen durch die Stelle trägt die für die Bereitstellung auf dem Markt verantwortliche Person, wenn die Prüfungen belegen, dass die Fernmeldeanlagen die verlangten Anforderungen nicht erfüllen.

4 Das BAKOM kann die Prüfung durch eine Stelle durchführen lassen, wenn es diese nicht selber durchführen kann. In diesem Fall werden der Person, die verantwortlich ist für die Bereitstellung einer Anlage auf dem Markt, die die erforderlichen Anforderungen nicht erfüllt, dieselben Kosten in Rechnung gestellt, wie wenn das BAKOM selbst die Prüfung durchgeführt hätte. Die Absätze 2 und 3 sind nicht anwendbar.

Art. 38 Tests by a body

1 OFCOM shall arrange for a body under Article 17 to test a telecommunications installation if:

a.
the tests carried out by OFCOM suggest that the installation does not meet the requirements of Articles 7 and 9; and
b.
the request is made by the person responsible for making the installation available on the market.

2 Before it arranges for an installation to be tested by a body under Article 17, it shall consult the person responsible for making it available on the market, in particular in relation to the chosen body, the extent of the tests and their estimated costs.

3 The costs of the tests by the body shall be paid by the person responsible for making the installation available on the market if the tests show that the installation does not meet the requirements.

4 OFCOM may arrange for the tests to be carried out by a body if it is unable to carry out the tests itself. In this case, the person responsible for making an installation available on the market that does not meet the essential requirements, or the owner of the fixed installation that does not meet these requirements shall be charged the same costs as would have applied if OFCOM had carried out the test itself. Paragraphs 2 and 3 do not apply.
