1 Eine gebrauchte Fernmeldeanlage darf nur auf dem Markt bereitgestellt werden, wenn sie die zum Zeitpunkt ihres Inverkehrbringens gültigen Anforderungen erfüllt und die anwendbaren technischen Normen oder Vorschriften nicht wesentlich geändert wurden. Artikel 35 gilt sinngemäss.
2 Eine gebrauchte Fernmeldeanlage, bei der für ihre Funktion wichtige Bauteile geändert wurden, unterliegt den gleichen Bestimmungen wie eine neue Anlage.
3 Wer eine gebrauchte Funkanlage auf dem Markt bereitstellt, muss der Erwerberin oder dem Erwerber Informationen betreffend eventuellen Verwendungseinschränkungen, die der Anlage zum Zeitpunkt des Kaufes beilagen, übermitteln.
4 Artikel 19 Absatz 4 gilt sinngemäss.
1 Second-hand telecommunications installations may be made available on the market only if they meet the requirements in force at the time they were first made available on the market and the applicable technical standards or regulations have not been substantially modified. Article 35 applies by analogy.
2 A second-hand telecommunications installation in which components which are important for its function have been modified shall be subject to the same provisions as a new installation.
3 Any person who makes second-hand radio equipment available on the market, must provide the purchaser with information on any restrictions on use that applied to the equipment at the time of its purchase.
4 Article 19 paragraph 4 applies by analogy.
