Art. 28 Sanktion bei fehlender Kompensation

1 Wer seine Kompensationspflicht nicht erfüllt, muss dem Bund pro nicht kompensierte Tonne CO2 einen Betrag von 160 Franken entrichten.

2 Zudem müssen dem Bund im Folgejahr im entsprechenden Umfang abgegeben werden:

a.
für das Jahr 2021: Emissionsminderungszertifikate;
b.
ab dem Jahr 2022: Emissionsrechte oder internationale Bescheinigungen.35

Art. 28 Penalty for failure to compensate

1 Any person who fails to fulfil an obligation to compensate must pay the Confederation the sum of 160 francs for each uncompensated tonne of CO2.

2 In addition, the following must be surrendered to the Confederation in the following year in the relevant amount:

a.
for 2021: emission reduction certificates;
b.
from 2022: emission allowances or international attestations.35
