Art. 91 Disziplinarrecht

1 Gegen Gefangene und Eingewiesene, welche in schuldhafter Weise gegen Strafvollzugsvorschriften oder den Vollzugsplan verstossen, können Disziplinarsanktionen verhängt werden.

2 Disziplinarsanktionen sind:

a.
der Verweis;
b.
der zeitweise Entzug oder die Beschränkung der Verfügung über Geldmittel, der Freizeitbeschäftigung oder der Aussenkontakte;
c.119
die Busse; sowie
d.120
der Arrest als eine zusätzliche Freiheitsbeschränkung.

3 Die Kantone erlassen für den Straf- und Massnahmenvollzug ein Disziplinarrecht. Dieses umschreibt die Disziplinartatbestände, bestimmt die Sanktionen und deren Zumessung und regelt das Verfahren.

Art. 91 Disciplinary regulations

1 Disciplinary sanctions may be imposed on prison inmates and inmates of an institution for the execution of measures who are guilty of infringing the institution regulations or the sentence management plan.

2 Disciplinary sanctions are:

a.
a reprimand;
b.
the temporary withdrawal or restriction of the right to use money, participate in recreational activities or have external contacts;
c.119
a fine; and
d.120
solitary confinement as an additional restriction of liberty.

3 The cantons shall enact disciplinary regulations applicable to the execution of sentences and measures. The regulations detail the disciplinary offences, the sanctions and how they are fixed, and regulate the procedure.
