Art. 301 Nachrichtendienst gegen fremde Staaten

1.  Wer im Gebiete der Schweiz für einen fremden Staat zum Nachteil eines andern fremden Staates militärischen Nachrichtendienst betreibt oder einen solchen Dienst einrichtet,

wer für solche Dienste anwirbt oder ihnen Vorschub leistet,

wird mit Freiheitsstrafe bis zu drei Jahren oder Geldstrafe bestraft.

2.  Die Korrespondenz und das Material werden eingezogen.

Art. 301 Military espionage against a foreign state

1.  Any person who conducts or organises the conduct of military intelligence gathering services on Swiss territory for a foreign state against another foreign state, and

any person who recruits persons for or facilitates such services,

shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.

2.  Any correspondence and other materials are forfeited.
