Art. 185bis Verschwindenlassen

1 Mit Freiheitsstrafe nicht unter einem Jahr wird bestraft, wer in der Absicht, eine Person für längere Zeit dem Schutz des Gesetzes zu entziehen:

a.
im Auftrag oder mit Billigung eines Staates oder einer politischen Organisation der Person die Freiheit entzieht, wobei in der Folge die Auskunft über ihr Schicksal oder ihren Verbleib verweigert wird; oder
b.
im Auftrag eines Staates oder einer politischen Organisation oder entgegen einer Rechtspflicht die Auskunft über das Schicksal oder den Verbleib dieser Person verweigert.

2 Strafbar ist auch, wer die Tat im Ausland begangen hat, sich in der Schweiz befindet und nicht ausgeliefert wird. Artikel 7 Absätze 4 und 5 ist anwendbar.

Art. 185bis Enforced disappearance

1 Any person who with the intention of removing a person from the protection of the law for a prolonged period of time:

a.
on behalf of or with the acquiescence of a State or political organisation, deprives that person of their liberty, and thereafter refuses to give information as to their fate or whereabouts; or
b.
on behalf of or with the acquiescence of a State or political organisation or in violation of a legal duty refuses to give information as to the fate or whereabouts of the person concerned.

shall be liable to a custodial sentence of not less than one year.

2 Any person who commits the offence abroad is also liable to the foregoing penalty provided they are now in Switzerland and are not extradited. Article 7 paragraphs 4 and 5 apply.
