Art. 115 Vergehen

Mit Geldstrafe bis zu 180 Tagessätzen wird bestraft, sofern nicht ein mit einer höheren Strafe bedrohtes Verbrechen oder Vergehen des StGB390 vorliegt, wer:391

a.
durch unwahre oder unvollständige Angaben oder in anderer Weise aufgrund dieses Gesetzes für sich oder einen anderen einen geldwerten Vorteil erwirkt, der ihm nicht zukommt;
b.392
sich durch unwahre oder unvollständige Angaben oder in anderer Weise der Pflicht zur Leistung der Sonderabgabe nach Artikel 86 ganz oder teilweise entzieht;
c.393

in der Absicht, sich zu bereichern, zu einer Straftat im Sinne von Artikel 116 Buchstabe c Hilfe geleistet hat, insbesondere durch Planung oder Organisation.

Art. 115 Misdemeanours

Any person who commits any of the following acts is liable to a monetary penalty not exceeding 180 daily penalty units, unless the act constitutes a felony or misdemeanour that carries a higher penalty under the SCC390:391

a.
obtaining, on the basis of this Act, for themselves or for another by providing false or incomplete information or in another way a pecuniary advantage that is not theirs by right;
b.392 completely or partly evading the duty to pay the special charge in accordance with Article 86 by providing false or incomplete information or in another way;
c.393

d.394 assists a person to commit an offence under Article 116 letter c with a view to his or her own financial gain, in particular through planning or organisation.
