Art. 86 Sozialhilfe und Krankenversicherung

1 Die Kantone regeln die Festsetzung und die Ausrichtung der Sozialhilfe und der Nothilfe für vorläufig aufgenommene Personen. Die Artikel 80a–84 AsylG268 für Asylsuchende sind anwendbar. Die Unterstützung für vorläufig aufgenommene Personen ist in der Regel in Form von Sachleistungen auszurichten. Der Ansatz für die Unterstützung liegt unter dem Ansatz für die einheimische Bevölkerung.269

1bis Für die folgenden Personen gelten bezüglich Sozialhilfestandards die gleichen Bestimmungen wie für Flüchtlinge, denen die Schweiz Asyl gewährt hat:

a.
vorläufig aufgenommene Flüchtlinge;
b.270
Flüchtlinge, die mit einer rechtskräftigen Landesverweisung nach Artikel 66a oder 66abis StGB271 oder Artikel 49a oder 49abis MStG272 oder mit einer rechtskräftigen Ausweisung nach Artikel 68 des vorliegenden Gesetzes belegt sind;
c.
staatenlose Personen nach Artikel 31 Absätze 1 und 2; und
d.273
staatenlose Personen, die mit einer rechtskräftigen Landesverweisung nach Artikel 66a oder 66abis StGB oder Artikel 49a oder 49abis MStG oder mit einer rechtskräftigen Ausweisung nach Artikel 68 des vorliegenden Gesetzes belegt sind.

2 Bezüglich obligatorischer Krankenversicherung für vorläufig aufgenommene Personen sind die entsprechenden Bestimmungen für Asylsuchende nach dem AsylG und dem Bundesgesetz vom 18. März 1994274 über die Krankenversicherung anwendbar.

Art. 86 Social assistance and health insurance

1 The cantons shall regulate the terms and the payment of social assistance and emergency aid for temporarily admitted persons. The provisions of Articles 80a–84 AsylA268 relating to asylum seekers apply. Support for temporarily admitted persons is normally provided in the form of benefits in kind. The level of support is less than that offered to persons resident in Switzerland.269

1bis The same provisions on social assistance standards apply to the following persons as for refugees who have been granted asylum in Switzerland:

a.
temporarily admitted refugees;
b.270
refugees subject to a legally enforceable order for expulsion from Switzerland under Article 66a or 66abis SCC271 or Article 49a or 49abis MCC272, or a legally enforceable expulsion order under Article 68 of this Act;
c.
stateless persons in accordance with Article 31 paragraphs 1 and 2; and
d.273
stateless persons subject to a legally enforceable order for expulsion from Switzerland under Article 66a or 66abis SCC or Article 49a or 49abis MCC, or a legally enforceable expulsion order under Article 68 of this Act.

2 In relation to compulsory health insurance for temporarily admitted persons, the corresponding provisions for asylum seekers in accordance with the AsylA and the Federal Act of 18 March 1994274 on Health Insurance apply.
