Art. 59

1 Das SEM kann an schriftenlose Ausländerinnen und Ausländer Reisedokumente87 ausstellen.

2 Anspruch auf Reisedokumente haben Ausländerinnen und Ausländer, die:

a.
gemäss dem Abkommen vom 28. Juli 195188 über die Rechtsstellung der Flüchtlinge die Flüchtlingseigenschaft erfüllen;
b.
gemäss dem Übereinkommen vom 28. September 195489 über die Rechtsstellung der Staatenlosen von der Schweiz als Staatenlose anerkannt sind;
c.
schriftenlos sind und eine Niederlassungsbewilligung haben.

3 Keinen Anspruch auf Reisedokumente hat, wer erheblich oder wiederholt gegen die öffentliche Sicherheit und Ordnung in der Schweiz oder im Ausland verstossen hat oder diese gefährdet oder die innere oder die äussere Sicherheit der Schweiz gefährdet oder rechtskräftig zu einer Landesverweisung nach Artikel 66a oder 66abis StGB90 oder Artikel 49a oder 49abis MStG91 verurteilt wurde.92

Art. 59

1 SEM may issue travel documents87 to foreign nationals without identification documents.

2 Foreign nationals are entitled to travel documents if:

a.
they meet refugee status in accordance with the Agreement of 28 July 195188 on the Legal Status of Refugees;
b.
they are recognised as stateless persons by Switzerland in accordance with the Treaty of 28 September 195489 on the Legal Status of Stateless Persons;
c.
they do not have identification documents but hold a settlement permit.

3 Any person who has seriously or repeatedly violated or represents a threat to public security and order in Switzerland or abroad, or who represents a threat to Switzerland’s internal or external security, or who is subject to a legally enforceable order for expulsion from Switzerland under Article 66a or 66abis SCC90 or Article 49a or 49abis MCC91 does not have a right to travel documents.92
