Art. 120d Zweckwidriges Bearbeiten von Personendaten in Informationssystemen des SEM

1 Jede zuständige Behörde stellt sicher, dass die Bearbeitung von Personendaten in Informationssystemen des SEM in einem angemessenen Verhältnis zu den verfolgten Zielen steht und allein erfolgt, soweit die Bearbeitung für die Erfüllung ihrer Aufgaben erforderlich ist.

2 Mit Busse wird bestraft, wer Personendaten:

a.
des nationalen Visumsystems oder des C-VIS für andere als die in den Artikeln 109a–109d vorgesehenen Zwecke bearbeitet;
b.
des EES für andere als die in Artikel 103c vorgesehenen Zwecke bearbeitet.

Art. 120d Improper processing of personal data in the SEM information system

1 Each competent authority shall ensure that the processing of personal data in the SEM information systems is proportionate to the objectives pursued and only takes place if it is required to fulfil the duties of the authority concerned.

2 The penalty shall be a fine for any person who:

a.
processes personal data in the national visa system or the C-VIS for purposes other than those specified in Articles 109a–109d;
b.
processes personal data in the EES for purposes other than those specified in Article 103c.
